IBM think Apple is Anti-Competitive!

In an uprecedented lawsuit, Apple is being sued by IBM due to the fact they have signed an agree with PowerPC chip maker.    According to Engadget:

IBM has filed lawsuits both against Apple in California (a state traditionally indifferent to non-competes) and against Papermaster, PA SEMI is the name of the aquired company, in New York.

Noting Apple’s saying “PA Semi have been competitors since 2006″ meaning that they have the right to look for other sources of income.   I have the feeling this will not end anytime soon.  Some analysts are predicting that there will not make any difference either way.   I am wondering why they did this in the first The

place.   Are they wanting to fight Apple?  Are they going to be able to do anything about it?  These are all just questions that I would like to see resolved in the next few weeks.

IBM is sueing because of an Non-compete clause.  clause stems from Mark Papermaster quiting IBM and joinin apple.  They claim that he can’t be a competitor to IBM for at least a year.  Most companies in California don’t bother with that clause because they don’t care about the clause.  Apple is saying this is bogus and notes that the lawsuit might not make it all the way to through th system.  So now only time will tell.

Sony recalls 340,000 batteries.

Sony Recalls Notebook Computer Batteries Due to Previous Fires

The following product safety recall was voluntarily conducted by the firm in cooperation with the CPSC. Consumers should stop using the product immediately unless otherwise instructed.

Name of Product: Rechargeable, lithium ion batteries containing Sony cells used in Fujitsu Computer Systems Corporation, Gateway Inc., Sony Electronics Inc., and Toshiba America Information Systems Inc. notebook computers.

Units: About 340,000 batteries (an additional 3,080,000 battery packs were sold worldwide)

Battery Cell Manufacturer: Sony Energy Devices Corp., of Japan

Hazard: These lithium ion batteries can overheat, posing a fire hazard to consumers.

Incidents/Injuries: There have been 16 reports of notebook computer batteries overheating, causing minor property damage and two minor burns. All of these reported incidents and injuries have been associated with earlier recalls of notebook computer batteries containing these Sony cells. There have been no incidents involving batteries sold by the notebook manufacturers participating in this announcement.

After looking around the blogosphere, I’ve come to the realization that people are starting to get hyped up over Windows 7.   In one blog post from it.toolbox.com:

Windows 7 is due to hit beta and release in 2009, and odds are likely that if the pundits, all of us on the blogosphere and other places like PC World, Cnet, and others all agree that this works the way a computer was supposed to work will help drive sales. What is also interesting is that Microsoft is really pushing to get this puppy out. Along with the bloat are gone the five years of development.

According to Time Inc. Editor in Chief John Huey is planning on Laying off over 600 jobs:

Time Inc., the world’s largest magazine publisher, plans to cut 6 percent of its work force — more than 600 positions — and will revamp the organization in a way that could radically alter the culture at the company.

Now let’s talk about the bigger picture, people are worried and want to get through this with out getting hit hard.   So what is true hardship, that comes when you least expect it and want it.  I’ve come to the conclusion that it will happen in the best of times.  You see most people don’t know what hardship is until it hits them in the square on the head.

Windows 7 Milestone 1 Leaked!

Many people have been wanting a copy of this so called elusive copy from PDC to test out and see where Microsoft is going.   Most developers are wanting to start to get into the stage of figuring out how they can get a step ahead of everyone else.   That being said, people have started to leak the Windows 7 on the Torrent sites.

We must assume Microsoft expected this and kinda wanted this to happen because when they gave this out they didn’t make it have any major copy protection.  Although we must not forget that there will be fakes out there and people are downloading this at a tramendous rate.  Most people will download it in under a day if you let it go!! I have not downloaded it because I am trying to get into the beta team for Windows 7 and don’t want to be to critical on the system.

This update resolves a privately reported vulnerability in the Windows Internet Printing Service that could allow remote code execution. An attacker who successfully exploited this vulnerability could take complete control of an affected system. An attacker could then install programs; view, change, or delete data; or create new accounts.

This update is rated Important for all supported editions of Microsoft Windows 2000, Windows XP, Windows Server 2003, and Windows Server 2008. For more information, see the subsection, Affected and Non-Affected Software, in this section.

The security update addresses this vulnerability by changing the way that memory is allocated within the Internet Printing Protocol (IPP) service. Now from what I understand, if you have a Network attached printer on your system this would make you more vulnerable to someone taking control over your system. So this patch is supposed to fix that. I am recommending to all to update this and fix this update ASAP. I do not know if you don’t have one what that would do so just install this update, because you will undoubtedly still be runing the Internet Printer Protocol even if you don’t have a printer.

Hulu Launches upcoming Movie Trailers Brought to you SPRINT!

Hulu launched movie trailers of the upcoming movies in the US.   Now to say the least I like the idea to be able to go to Hulu on a Sprint Instinct or other mobile devices to see before I go to the movies.   So the ones I like right now are Star Wars :  Clone Wars.

Fidelelity to Lay off more than 4000 people in 2008.

Fidelity Investments acknowledged yesterday it is studying cost cutting but declined to comment on an industry report that it plans to lay off up to 4,000 employees as plunging stock markets cut into the value of its mutual funds business.

As you can see you can get a good look around the US.   If you want to check out your local area or maybe you know you Latitude and Longitude of where you live.  You can also enter that too and see it in the past.  It at least brings back memories for me.  For example, the Twin Towers, they still have that photo. You could also look at the White House before 9/11 also. Go check out the Micrsoft Terraserver and go have some fun looking at old pictures.

Did you Recieve a Check from Shadow Shopper? (Scam)

I just got done checking my sources and here what I know and I will quote:

Will ShadowShopper.com ever send a job to me via regular mail?
Never. We will always contact you via email. If you do receive a letter in the mail claiming to be from ShadowShopper (with a realistic looking logo) and asking you to mystery shop by cashing a large check THROW THAT OFFER AWAY. It is a Nigerian check scam ring pretending to be Shadowshopper. The scam is run out of Canada and the UK, and the check will bounce. Remember, ShadowShopper provides you with hundreds of job opportunities, and for your protection, we do it only via email and our website.

It is a Scam to send you money Via the postal mail and that is why you must not believe what you get in the mail. This is in response to someone telling me they got a check with a different name but for the same reason to cash the check and send money to them.

In the Newsletter, Calicanis says this:

As a startup, you are now, officially, on your own. You can’t count on
your VCs saving you or some magical offer from Yahoo or Google showing
up to bail you out. Chances are Yahoo and Google are going to be
shutting down and/or selling off companies they’ve already
bought–like EBAY and AOL have started doing. Parents don’t adopt
while they’re putting their kids up for adoption.

Now I don’t know about you but I am really worried about what people are going to do next. Some other things Jason said is that the storm is upon us. That’s right, in the next thirty days you will have to figure out how to survive. It won’t be easy. Is this the beginning or the ending of this so called storm? I say only time will tell. I hope this becomes a rebound soon. We are definitely in for the long haul.

Microsoft reveals “Microsoft Azure”

Windows Azure is part of a set of new and existing technologies behind the Azure Services Platform, a development and execution platform that runs end-user and corporate software on Microsoft’s own servers, accessible over the web. It joins Google’s App Engine and Amazon’s EC2 in an increasingly competitive market.

Although,  There isn’t much more they have said I am quite curious how they will interegrate this into the cloud computing.  According to Microsoft, it won’t run on the company server but  Microsoft Datacenter.  Now this I can see is a big security problem.   Because most companies use what they call an Intranet and not the internet.  So that leaves questions on if companies are going to use this system or not.   Are you ready to let your information float somewhere over the inernet tht is SENSITIVE and CONFIDENTIAL?   These are the questions that Microsoft will have to Answer, before any company will use this on there systems.

Since Black Friday is approaching next month, I Figured it is time to point to places where you could find them.  Now that being said, I don’t think people should take some of these ads serious because of all the possibility.  Where these ads are being placed is not going to be the absolute final end all price.   Knowing these competitors like I do, they are going to have an ace in the hole.  You will probably not find out until a week or a few days before black Friday.

They will of course try to keep the really juicy stuff out of the hands of people who blab about this on the net.

Oprah Recommends the Kindle!

Today in Chicago, and on TV screens across the USA, Oprah Winfrey is going to recommend her new “favorite gadget,” which is Amazon’s Kindle ebook reader. UPS expected to layoff people also

According to New York Times:

United Parcel Service reported a 9.9 percent drop in quarterly profit on Thursday and said it expected consumers to cut back on holiday gift purchases.  The company is planning cost cuts, including layoffs, in 2009. It said it expected profit for 2008 to be toward the low end of a range it provided in July.

I was searching for a program to help boot up my system a lot quicker.   I came across this little program call Startup Delayer.  In a nutshell, it allows you to pick which programs to start up first and then lets you decide how many minutes between each program that is asking to load.

In the best way possible you can download this program and use it for yourself.   Although they seem to be having a little server problem right now.   Go download Startup Delayer, and decide for yourself.

Microsoft Windows Server Service Vulnerability (MS08-067)

A vulnerability has been identified in Microsoft Windows, which could be exploited by attackers to take complete control of an affected system. This issue is caused by an error in the Server service that does not properly handle specially crafted RPC requests, which could be exploited by attackers to crash an affected system or execute arbitrary code via a specially crafted request.

On Windows Vista and Windows Server 2008, the vulnerability is only exploitable by authenticated users.

Note: This vulnerability is being exploited in targeted attacks.

This was just discovered and needs to let people know. I will do more research on it and maybe come up with a way to fix the problem. According to my sources there is a patch that will fix the problem!!

According to Microsoft:

On Microsoft Windows 2000, Windows XP, and Windows Server 2003 systems, an attacker could exploit this vulnerability without authentication to run arbitrary code. Firewall best practices and standard default firewall configurations can help protect network resources from attacks that originate outside the enterprise perimeter.

Largest Employer : University of Pittsburgh Medical Center is planning layoffs!!

Is this the beginning or the end of the recession?  After  seeing this today I wanted to talk about this development.  If they layoff a large number of people is this going to effect your chances of finding a job?  Here’s what they had to say:

The University of Pittsburgh Medical Center has plans to reduce its 50,000 workforce by a small percentage. UPMC did not immediately release any specifics.

“As the economy deteriorates, we are proactively taking these steps to ensure that our growth in expenses is not outpacing our growth in revenues,” a UPMC statement said.

Mahalo Lay’s off around 10% of it’s workforce!!

In an email he sent to the readers of his publication, Jason Calicanis talks about having to lay off around 10% of people from Mahalo.  Here’s the quote:

We’ve laid off a just under 10% of our full-time staff, cut our overhead by doing smart things like renting desks (we have six desks/offices available fyi), and reorganized our editorial department to focus on freelance positions over in-house editors. The net result
of the effort is we are giving Mahalo another year of “dry powder” (or runway) to complete our mission.

This is not to be unexpected after all the talk about the recession coming our way. It does however emphasizes the need for companies to consider there profit margins and accounting strategy.

Mahalo was launched in May 2007 as an Alpha test. That is to say only a select number of people were able to access the site and create feedback to the development of the site. As of January of 2008 it is in what we call the Beta test phase. Which means more people are testing it out and find out it’s flaws to report back about where they need to improve.  Mahalo’s directory employs human editors to review websites and search engine results.

Western Kentucky Shooting.

BOWLING GREEN, Ky. (CBS) ― Western Kentucky University was on lockdown Wednesday after someone reported seeing people with weapons in a building on a satellite campus and police later received reports that shots had been fired on the main campus, more than a mile away.

The Daily Wireless also has a review on it on there site. I also found The Boy Genius talks about there review also. They all seem to look favorable to the G1. Engadget also talk about it looking at the expectations of the G1. So far everyone seems to love the G1. All in All, I think the Iphone is in for a rude awakening. So I get this email talking about this show that I liked to watch when I was a kid.  Talking about The Pretender : Donterase – Season 3 episode 21.   So I watch it and wanted to let people know that they had that episode and probably more to come!!!  Keep an eye out for more!!  According to IMDB that was a 2 part episode so there must be another one coming. I’ll post as soon as I find out!!

Google introduces the Androids G1 today!

With the recent announcement of Apples earnings. So now that Google released this, is Apple going to be able to keep up the steam with the Iphone? Which phone are you going to buy the Iphone or the Android G1? So far T-mobile has did pre-orders on the phone now to see what the earnings are for this little adventure? Is it enough?

Apple reports there earnings for the quarter!

After all that happened today, Apple decides to talk about there earnings for today.  Some things to consider are:


Apple ships more than 2.6 million Macs and 6.9 Billion Iphones.   Now let’s do the numbers on this 6.9 billion Iphones at an average over 500$ a piece would mean quite a earnings for Apple.  This according to Applewatch and I’ve got to think is this showing the real economy or is this all hype from Steve Jobs?

According to M&G Business they are up 24 per cent this fiscal year.  Which means that they have gain ahead from the recent problems in the stock market.  Are they going to be able keep that going?

Last but final least saying of the day Gizmodo is stating : Steve is on the call, says that iPhone is now 39 percent of their business, Apple is now world’s “third largest mobile phone supplier.”

Now what about the Google Phone is that going to out sale the Iphone?  I would like to know the current status of how man Google phones they have estimation sold on pre-orders?  Are they going to be able to out do the Iphone or is it going to be even more of a problem when they release the final numbers on the G-phone!!
